ACB Court ordered 14 day – judicial custody to three accused in a MLA poaching case

Hyderabad: The ACB Court ordered 14 day-judicial custody to the three accused facing the allegations in MLAs poaching case. The Cyberabad police produced three accused namely Ramachandra Bharathi a.k.a. Satish Sharma, Kore Nanda Kumar a.k.a. Nandu and Simhayaji before ACB Court judge at his residence in Saroornagar.

They were re-arrested on Saturday on the orders of the Telangana High Court. The judge remanded them to 14 day- judicial custody. The accused were subsequently shifted to Chanchalguda Central Jail.

The High Court set aside ACB Court’s order rejecting the remand of the accused allegedly linked to BJP. The High Court directed the lower court to send the accused to remand if the police produce them again.

As per the High Court orders, Cyberabad police re-arrested the accused and taken them to Moinabad police station where a case was registered against them after they were caught at farmhouse on October 26th while trying to lure four MLAs of the TRS with offers of huge sums of money.

Justice Chillakur Sumalatha of the High Court passed the orders on a criminal revision petition filed by the Cyberabad police seeking to set aside the ACB Special Court judge order rejecting remand of the accused. The ACB Court judge had rejected the remand application of the accused when they were presented before him late on Thursday night.

The judge had observed that the police failed to comply with the mandatory procedure of issuing notices to the accused under section 41A of CPC.
