Government breached protocol on challenging CAA in Supreme Court: Governor Arif
Thiruvananthapuram: Kerala Governor Arif Mohammad Khan pointed out the State Government’s decision of challenging CAA in the Supreme Court on Tuesday is a breach of protocol. The Kerala Govenor said that he know the information through media, it is a courtesy of the Government to inform the Governor on the issue and get prior permission from him.
The Governor said that, he is not saying that what the Government did is wrong, they may have every right to approach the Supreme Court. He also suggested he will check if the State Government can do this without permission from the Governor.
The Kerala Government in its petition has called the CAA a violation of several articles of the constitution including the right to equality. The law goes against the basic principle of secularism in the constitution. The State Government has also challenged the validity of the changes made in 2015 to the passport law and the foreigners order, regularizing the stay of non-Muslim migrants from Pakistan, Afghanistan and Bangladesh who had entered India before 2015. Over 60 Writ petitions have been filed in Supreme Court so far against the CAA. Various political parties, NGO’s and also MPs have challenged the law. The Supreme Court will hear the petitions on January 22nd.
