SC tells High Courts not summon Government officials to the Court unnecessarily

New Delhi: Supreme Court on Friday said the Courts cannot summons Government officials unnecessarily to the Courts for hearing. The two Judges bench comprised with Justice Sanjay Kishan Kaul and Justice Hemanth Gupta made these comments on the complaint made by the Health Secretary of Uttar Pradesh against the orders of the Allahabad High Court.

The bench urged the Courts not to call government officials unnecessarily. Being called by them does not increase your self esteem. It should not be attributed unless it earns respect for the Courts. Note that if an officer comes to Court another work that he needs will stop.

Sometimes officers have to travel long distances for Court calls. So calling the authorities is against the public. There is no such thing as a pony Court ruling that will come at the appointed time. Can’t say how late it will be.

Give the government or government officials enough time to respond said the bench. The Supreme Court has made it clear that it would not be happy to call officials to the Courts casually, often, casually.

Judges must be humble and obedient. They are not emperors. The legislature, the executive, and the judiciary all have their jurisdictions. It is not right for one to want to infiltrate another’s powers. Doing so would upset the constitutional balance.

The outcome will have to be felt, the bench said. The Court clarified that the officers have a lot of important work to do, all of which will be delayed due to unnecessary summons to the Courts. Those tasks will be further delayed as the over burden will place an additional burden on the officer. The SC bench set aside the lower Court orders.
