AP SEC Case Will Hear After Two Weeks: Supreme Court

New Delhi: The Supreme Court directed the respondent former SEC Nimma Gadda Ramesh and other respondents to file their detailed counter affidavits within two weeks, on raising objections of the AP High Court judgement by the petitioner AP govt. The Supreme Court on Wednesday refused to issue stay orders on the AP High Court’s judgement on the former state election commissioner’s case. The Supreme Court also refused to issue directions to the state government on reinstate of the former SEC’s counsel request.

The three judge bench headed by chief justice of India Justice S A Bobde, Justice A S Bopanna and Justice Hrishikesh Roy told both parties that the case will be hear in detail of after two weeks. Senior advocates Mukhul Rohat Gi, Rakesh Dwivedi, Sekhar Naphade and Shyam Divan to make good its appeal before the judges.

Senior counsel Mukhul Rohat Gi arguing on behalf of state government said that the appointment to the office of SEC is held in the discretionary space of the governor which is contrary to the judgments of the Supreme Court. He said that the High Court went into the questions of motives of ordinance which is not available as a ground.

Another senior counsel Rakesh Dwivedi also argued on behalf of the state government. He said that the High Court held in its judgement that Sec 200 of Andhra Pradesh Panchayat Raj act is in consistence with the spirit of the constitution and then directed to restore Ramesh Kumar as SEC who was appointed under the same section.

The Supreme Court said that it will hear the matter after two weeks and issued notices, the counsels for state sort interim relief and requested to stay High Court order.
