Rajasthan Speaker files SLP in Supreme Court against the High Court’s order

New Delhi: The Rajasthan Assembly Speaker CP Joshi moved the Supreme Court on Wednesday challenging the High Court’s July 21st request- cum- directive to differ till July 24th the disqualification proceedings against 19 rebel Congress MLAs led by Sachin Pilot he had indicated on Tuesday  to abide by the HC’s directive.

The postponement of disqualification proceedings in difference to HC directive over night changed into a challenge before the SC through a special leave petition. The speaker in SLP questioned the High Court’s Jurisdiction to intervene in pending disqualification proceeding, in which notices were issued to the rebel MLAs on July 14th to respond by July 17th.

The MLAs had challenged the validity of the notices before the High Court, which reserved its decision after conclusion of arguments on Tuesday. a bench of Justices Arun Mishra, B.R. Gavai and Krishna Murari is scheduled to hear the petition on Thursday. The Speaker CP Joshi said the High Court could not have directed him on pending disqualification proceedings and it amounted to interference in the proceedings of the house.

Rising a fundamental question against the High Court Jurisdiction, the Speaker said the Supreme Court, in its land mark Kihoto Hollohan Judgement in February 1992, had barred judicial intervention in disqualification proceedings pending before the Speaker.

Rajasthan former Deputy Chief Minister Sachin Pilot also filed a Cavite petition in the Supreme Court, where the Speaker files SLP. Pilot urged the Court that before taking the consideration of the SLP in the Court, he requested the Court to hear his voice on disqualification of 18 MLAs along with him, before hearing the Speaker’s SLP.
